Prelove You, Inc. is a subscription-based service for preloved children’s clothing, promoting sustainability and circular fashion by allowing members to exchange, reuse, and upcycle garments.
Privacy Policy
Prelove You, Inc. does not share customer details with any third parties. If a payment defaults, members have up to five days to correct the issue, or they will forfeit any points or credits earned.
Accepting Preloved Clothing
Members can send in as many garments as they wish. If an item is not re-offered on our site, we will issue 1 credit for responsibly upcycling the garment. All clothing sent to Prelove You, Inc. becomes our property and will not be returned under any circumstances.
Delivery and Shipping Policy
Members are responsible for all shipping costs associated with sending items to Prelove You, Inc., as well as the costs of receiving any items from Prelove You, Inc. We aim to ship orders within five working days using USPS, UPS, or FedEx. Shipping times may vary based on carrier availability, and exceptions may apply under certain circumstances. Please contact us for further details if needed.
Refunds
All clothing can be returned at any time. If, in our opinion, the clothing is in “prelovable” condition and is added back to our site, credits will be issued according to our grading system.
Cancellation Policy
Orders can be canceled by either party if the item has not yet been shipped. Any orders flagged by our system as potentially fraudulent will be automatically canceled. This procedure is a safeguard to protect Prelove You, Inc. against online fraud.
Subscription and Membership Terms
Prelove You, Inc. operates on a recurring subscription model, available in monthly or quarterly payment options. Your membership will automatically renew at the end of each billing cycle unless canceled prior to the renewal date. Members may cancel their subscriptions at any time, but any unused credits will be forfeited upon cancellation. Additionally, any account found to be in violation of our terms and conditions, including the prohibited use of the service, will be subject to immediate termination without a refund of any credits or membership fees.
Prohibited Use of Service
Prelove You, Inc. is intended for personal use only. If we determine, or have reasonable grounds to suspect, that a member is using the service to sell or otherwise profit from the items obtained through Prelove You, Inc., we reserve the right to terminate that member’s account without notice. In such cases, the member will forfeit any accumulated credits, and their membership will be canceled immediately.
Prelove You, Inc. Items
Some garments may not have washing instructions labeled. For sanitary reasons, we do not accept underwear for exchange. However, feel free to send them in for responsible upcycling.
Please allow 5-7 business days after we receive your items for us to process the clothing and issue credits.
Please note that images of Prelove You, Inc. items may vary slightly in color or texture from what you view on our website compared to what you receive.
Origin of Clothing
Some of our clothing may come from homes with pets. If you have concerns regarding potential pet dander, we recommend laundering the items before use to ensure your comfort.
Allergy Disclaimer
Prelove You, Inc. cannot be held responsible for any allergic reactions due to pet dander or detergents used prior to shipping. We encourage customers to order at their discretion and to launder items upon receipt if necessary to mitigate allergy concerns.
Smoke-Free Policy
To maintain high standards of quality and hygiene, Prelove You, Inc. does not list or ship any clothing from homes where smoking is practiced. Clothing from such environments will be responsibly upcycled instead of being made available to members.
Damage or Lost Items During Shipping
Prelove You, Inc. is not responsible for any items lost or damaged during shipping, whether the items are being sent to us or shipped to the member. If an item is lost or damaged in transit, please contact us, and we will work with the shipping carrier to resolve the issue. However, we cannot guarantee replacement or reimbursement in such cases.
Intellectual Property
All content on the Prelove You, Inc. website, including images, text, and designs, is the intellectual property of Prelove You, Inc. and is protected by copyright law. Members may not copy, reproduce, or distribute any content without written permission from Prelove You, Inc.
Limitation of Liability
Prelove You, Inc. is not liable for any indirect, incidental, or consequential damages arising from the use of our service, including but not limited to issues related to allergies, product dissatisfaction, or service interruptions. By using our service, you agree that any legal claims against Prelove You, Inc. will be limited to the value of your subscription fees.
Indemnification
You agree to indemnify, defend, and hold harmless Prelove You, Inc., its officers, directors, employees, agents, and affiliates, from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorneys’ fees and costs, arising out of or in any way connected with your access to or use of the service, your violation of these Terms and Conditions, or your infringement of any third-party rights, including intellectual property rights.
Force Majeure
Prelove You, Inc. shall not be held liable for any failure to perform its obligations under these Terms and Conditions due to events beyond its reasonable control, including but not limited to acts of God, war, terrorism, pandemics, labor disputes, government actions, natural disasters, or failures in telecommunications or internet services.
Modification of Terms
Prelove You, Inc. reserves the right to modify or update these Terms and Conditions at any time. Any changes will be effective immediately upon posting the updated terms on our website. It is the member’s responsibility to review the Terms and Conditions regularly to ensure they are aware of any changes. Continued use of the service constitutes acceptance of any revised terms.
Non-Transferability of Membership
Memberships and any associated credits are non-transferable and non-assignable. Members may not sell, transfer, or assign their membership, credits, or any other rights or obligations under these Terms and Conditions to any third party without the express written consent of Prelove You, Inc.
Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. Any legal proceedings arising out of or relating to these terms shall be exclusively brought in the state or federal courts located in Westchester County, New York.
Entire Agreement
These Terms and Conditions, along with any policies and guidelines posted on the Prelove You, Inc. website, constitute the entire agreement between you and Prelove You, Inc. with respect to your use of the service. This agreement supersedes all prior or contemporaneous communications, whether electronic, oral, or written, between you and Prelove You, Inc. with respect to the service.
Severability
If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, such provision will be enforced to the maximum extent permissible, and the remaining provisions of these Terms and Conditions will remain in full force and effect.
Dispute Resolution
In the event of any disputes arising from the use of Prelove You, Inc.’s services, both parties agree to first attempt to resolve the issue through informal negotiation. If a resolution cannot be reached, the parties agree to submit the dispute to binding arbitration in accordance with the rules of the American Arbitration Association.
